The DUMA STORE website is owned by the company DU.-MA.doo, info@duma.hr, Zagreb. The use of the services and content of the website is regulated by these Terms of Use.<\/p>

The Terms of Use stipulate the conditions and rules for end users and relate to the use of the DU.-MA.doo website. By using the website, end users indicate that they agree with the General Terms of Business and Use and agree to use the website in accordance with them.<\/p>

All materials on the DUMA STORE website are the intellectual property of DU.-MA.doo and may only be used with the express permission of the copyright holder and the holder of trademark and\/or design rights.<\/p>

The user can send their inquiries and comments in writing, by post or e-mail, and DU.-MA.doo will send a written response by post or e-mail within the legal deadline.<\/p>

BASIC TERMS<\/h5>

For the purposes of these terms of sale, a buyer is a natural or legal person who orders at least one product through the DU.-MA.doo website, fills in the required information and pays for the ordered product.<\/p>

If information about a legal entity is entered in the buyer's data, then the buyer is considered a legal entity, and the natural person whose data is entered is considered the authorized person of the buyer.<\/p>

PERSONAL DATA AND BUSINESS CAPACITY<\/h5>

For a valid product order, the person completing the order must be over 18 years of age (legal capacity).<\/p>

The buyer is responsible for the accuracy and completeness of the data entered during registration.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

ONLINE PAYMENT SECURITY STATEMENT<\/strong><\/p>

When paying on our web store, use Teya - an advanced system for secure online payment card acceptance.<\/p>

Teya ensures complete confidentiality of your card details from the moment you enter them in the Teya payment form. Payment details are transmitted encrypted from your web browser to the bank that issued your card. Our store never comes into contact with the complete details of your payment card. Also, the data is inaccessible even to Teya system employees. The isolated core independently transmits and manages sensitive data, keeping it completely secure.<\/p>

The form for entering payment data is secured with an SSL transport code of the highest reliability. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. Teya meets all the requirements related to the security of online payments prescribed by the leading card brands, that is, it operates in accordance with the norm - PCI DSS Level 1 - the highest security standard of the payment card industry. When paying with cards included in the 3-D Secure program, in addition to the validity of the card itself, your bank also confirms your identity using a token or password.<\/p>

Teya considers all collected information to be bank secrecy and treats it accordingly. The information is used exclusively for the purposes for which it was intended. Your sensitive data is completely safe, and its privacy is guaranteed by the most modern protection mechanisms. Only the data necessary to perform the job in accordance with the prescribed demanding procedures for online payments is collected.<\/p>

The security controls and operational procedures applied to our infrastructure ensure the immediate reliability of the Teya system. In addition, by maintaining strict access control, regular security monitoring and in-depth checks to prevent network vulnerabilities, and planned implementation of information security provisions, they permanently maintain and improve the level of system security by protecting your card data.<\/p>

As a measure in accordance with the 'Secure Payment' system and for the purpose of cooperating with the aim of preventing online fraud, DUMA STORE reserves the right to verify the personal data provided by customers and to take appropriate steps (including canceling the order) to ensure that the goods are delivered in accordance with the data specified in the order.<\/p>

PERSONAL DATA PROTECTION<\/h5>

Personal data includes your identification data: name and surname, e-mail address, home address and telephone number, or data that is not otherwise publicly available, but which DU.-MA.doo learns about during your use of the online store.<\/p>

DU.-MA.doo undertakes to use your personal data only for identification purposes when using the online store, to enable you to use all the options it provides, and to keep them confidential, i.e. not distribute them, publish them, give them to third parties for use, or make them available to any third party in any other way without your prior consent.<\/p>

STATEMENT ON THE PROTECTION AND COLLECTION OF PERSONAL DATA AND THEIR USE<\/h5>

DU.-MA.doo is committed to protecting the personal data of customers, by collecting only the necessary, basic data about customers\/users that are necessary to fulfill our obligations; informing customers about the use of the collected data, regularly giving customers the opportunity to choose how their data is used, including the opportunity to decide whether or not they want their name to be removed from lists used for marketing campaigns. All user data is strictly kept and is only accessible to employees who need this data to perform their job. All employees of DU.-MA.doo and business partners are responsible for respecting the principles of privacy protection.<\/p>

ELECTRONIC COMMUNICATION<\/h5>

By visiting our online store, you are communicating electronically. You hereby agree that all agreements, notices, communications and other content delivered to you electronically meet the legal requirements as if they were in writing.<\/p>

PRICE<\/h5>

DU.-MA.doo undertakes to clearly, visibly and legibly display the retail price in accordance with Article 7 of the Consumer Protection Act (Official Gazette 41\/14).<\/p>

DU.-MA.doo will periodically, in accordance with its decision, put certain products on sale at a price lower than the price of these products in regular sales, and it also undertakes to clearly and legibly mark and state the duration of the sale.<\/p>

After the sale period has expired, DU.-MA.doo will not accept orders under the terms and conditions of the sale period that has expired.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

PRODUCT AVAILABILITY<\/h5>

Due to the large number of orders submitted simultaneously to DU.-MA.doo, it may happen that information about product availability is not identical to the stock status.<\/p>

If the ordered product is not available in stock, DU.-MA.doo will inform the customer that the product is currently unavailable, the time frame within which the product is available, and also offer the possibility of purchasing an alternative product from DU.-MA.doo that is available for delivery and that is closest in characteristics to the product that cannot be delivered.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

ORDER AND MOMENT OF CONCLUSION OF THE CONTRACT<\/h5>

Products are ordered by selecting, using the menu and filling out an electronic form. The customer can order and purchase the product as a registered or unregistered user. The product is considered ordered when the customer completes the entire ordering process.<\/p>

Payment for ordered products can be made in the following ways:<\/p>

\u2013 By card payment<\/p>

\u2013 By general payment \/ bank transfer \/ e-banking<\/p>

At the moment the order is received, DU.-MA.doo will electronically notify the customer in the form of an e-mail that the order has been received or that the product has been successfully ordered.<\/p>

If you do not receive the notification from the previous paragraph, it is recommended to check:<\/p>

\u2013 is the message in the Junk\/Spam folder?<\/p>

\u2013 is the mailbox full?<\/p>

- whether the items are in the basket, and if they are not, it is necessary to repeat the ordering process<\/p>

After the delivery person picks up the shipment, the buyer will be notified via email that the shipment has been sent.<\/p>

In the case of payment via e-banking and general payment, the contract is considered concluded at the moment when DU.-MA.doo receives confirmation that the order amount has been paid.<\/p>

If a product is ordered and e-banking or general payment is selected as the payment method, DU.-MA.doo undertakes to reserve the product in the warehouse for a period of 3 business days, excluding Saturdays. After 3 business days from receipt of the order, DU.-MA.doo does not guarantee the availability of the product.<\/p>

The postage price is not included in the product price.<\/p>

For all orders worth up to \u20ac100, the delivery price is \u20ac6.25. For orders over \u20ac100, delivery is free (by selecting the free delivery option in the menu).<\/strong><\/em><\/span><\/p>

If payment via e-banking or a general payment slip is selected as the form of payment, and DU.-MA.doo does not have the ordered product due to a lack of goods in stock, the buyer will be notified within a reasonable period of time and DU.-MA.doo will refund the paid funds in agreement with the buyer.<\/p>

In the case of the above payment, the buyer is responsible and bears the risk for the accuracy and truthfulness of the submitted data, given that DU.-MA.doo will refund the funds in accordance with the submitted data.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

DELIVERY<\/h5>

Products can be ordered for delivery within the Republic of Croatia, according to the conditions that apply to each delivery area.<\/p>

DU.-MA.doo undertakes to deliver the ordered product within 15 days from the date of conclusion of the contract.<\/p>

Delivery is carried out in accordance with the terms of use of the delivery service, and is considered completed at the moment the product is handed over to the delivery service.<\/p>

If a product sent to the buyer or recipient is returned to DU.-MA.doo because the delivery service failed to deliver, the buyer will be notified by e-mail and will be offered the option of resending.<\/p>

We reserve the right to make multiple deliveries per individual order, if this is appropriate for logistical or other reasons for the ordered goods, about which we or our business partners will inform you.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

UNILATERAL TERMINATION OF THE CONTRACT<\/h5>

You can unilaterally terminate the contract within 14 days without giving a reason.<\/p>

In order to exercise the right to unilaterally terminate this Agreement, you must inform us of your decision to unilaterally terminate the Agreement before the expiry of the deadline by an unambiguous statement sent by e-mail to info@duma.hr, in which you will state your name and surname, address, telephone number, fax number or e-mail address, and you can also use the proposed example of the form for unilateral termination of the Agreement.<\/p>

EXAMPLE OF A FORM FOR UNILATERAL TERMINATION OF A CONTRACT<\/h5>

We will send you confirmation of receipt of the statement or form for unilateral termination of the contract, without delay, by email.<\/p>

The deadline for unilateral termination is 14 days from the day on which you or a third party designated by you, who is not the carrier, have been given possession of the goods that are the subject of the contract.<\/p>

If you unilaterally terminate this Agreement, we will refund the money we received from you, including delivery costs, without delay, and no later than within 14 days from the day we received your decision to unilaterally terminate the agreement, unless you have chosen another type of delivery that is not the cheapest standard delivery that we have offered.<\/p>

The refund will be made in the same way you made the payment. In the event that you agree to another way of returning the amount paid, you do not bear any costs in relation to the return.<\/p>

We can only issue a refund after the goods have been returned to us or after you provide us with proof that you have sent the goods back to us.<\/p>

It is considered that you have fulfilled your obligation on time if you send or hand over the goods to us, or to the person we are authorized to receive the goods, before the expiry of the aforementioned period.<\/p>

You must bear the direct costs of returning the goods yourself.<\/p>

You are responsible for any decrease in the value of the goods resulting from the handling of the goods, except that which was necessary to determine the nature, characteristics and functionality of the goods<\/p>

The consumer does not have the right to unilaterally terminate the contract if:<\/p>

- the subject of the contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were opened after delivery<\/p>

-subject of the contract is perishable goods or goods that expire quickly<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

MATERIAL DEFECTS OF PRODUCTS AND COMPLAINTS<\/h5>

If the buyer notices material defects in the delivered product as provided for in Article 401 of the Civil Obligations Act and for which the Seller is liable under Article 400 of the Civil Obligations Act, the buyer may, at his option, under Article 410 of the same Act:<\/p>

1) require the seller to eliminate the defect,<\/p>

2) require the seller to deliver another item without defects,<\/p>

3) declare that he is terminating the contract (according to Article 412 of the Civil Obligations Act - if he has previously given the seller a subsequent appropriate deadline for fulfilling the contract. The buyer may terminate the contract without setting a subsequent deadline if the seller, after being notified of the defects, has informed him that he will not fulfill the contract or if it is obvious from the circumstances of the specific case that the seller will not be able to fulfill the contract even within the subsequent deadline, as well as in the case where the buyer cannot achieve the purpose for which he concluded the contract due to the seller's delay).<\/p>

If the seller fails to fulfill the contract within the additional period, it is terminated by law, but the buyer can maintain it if he declares to the seller without delay that he is maintaining the contract in force.<\/p>

The same applies in the case of performance with a deficiency in the obligation, where performance within a certain period is an essential element of the contract.<\/p>

The buyer loses the right to terminate the contract due to a lack of goods when it is impossible for him to return the goods or return them in the condition in which he received them.<\/p>

However, the buyer may terminate the contract due to a defect in the item if the item has completely or partially failed or been damaged due to a defect that justifies termination of the contract, or due to an event that does not originate from him or from a person for whom he is responsible.<\/p>

The same applies if the item is completely or partially destroyed or damaged during the fulfillment of the buyer's obligation to inspect the item, or if the buyer, before the defect was discovered, consumed or modified a part of the item during its regular use, and if the damage or modification is insignificant.<\/p>

A buyer who has lost the right to terminate the contract due to the inability to return the item or to return it in the condition in which he received it, retains other rights granted to him by law due to the existence of a defect.<\/p>

After the buyer sends a written notification to the seller to the email address info@duma.hr and if it is determined that the complaint is justified, DU.-MA.doo will remove the defect in accordance with the agreement with the buyer.<\/p>

The buyer returns the product with a detected defect to the seller at the seller's expense.<\/p>
